1. Acceptance of Terms

By accessing or using Couch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and others who access or use Couch.

2. Description of Service

Couch is a real-time chat platform that lets you watch and discuss live television with others. The Service is operated by Couch Up, LLC. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

3. User Accounts

To access certain features, you may create an account using your email address. You are responsible for keeping your account secure and for all activity that occurs under your account. You must be at least 13 years old to use the Service. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use the Service to:

  • Post content that is abusive, harassing, threatening, or hateful
  • Share spam, misleading information, or unsolicited commercial messages
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to any part of the Service
  • Violate any applicable law or regulation
  • Post content that infringes on the intellectual property rights of others

We may remove content or suspend accounts that violate these rules at our discretion.

5. Content Ownership

You retain ownership of any content you post on Couch. By posting content, you grant Couch Up, LLC a non-exclusive, royalty-free, worldwide license to display and distribute that content as part of operating the Service. You represent that you have the right to grant this license.

Couch Up, LLC owns all rights to the Service itself, including its design, software, and branding.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, Couch Up, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

8. Changes to Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes your acceptance of the revised terms.

9. Governing Law

These terms are governed by the laws of the United States and the state in which Couch Up, LLC is registered, without regard to conflict of law principles.
